Only those aged 18 and over can access online gambling platforms, with minors banned from doing so, the ANJL reiterated in a press release on Tuesday (28 January).

To access betting sites authorised by the federal government, Brazilians must share their Individual Taxpayer Registration (CPF) number and pass facial recognition checks to prove their identity and confirm they are at least 18-years-old.

However, the ANJL warns the age limit will only work with the cooperation of parents and guardians, who theoretically could allow children to circumvent the restrictions by allowing them to use their own personal data, which is a criminal offence.

As a result, the ANJL places the responsibility on parents to comply with the regulations and ensure only adults are betting in Brazil.

“The Association has done its part in creating mechanisms to prevent access by minors,” ANJL president, Plínio Lemos Jorge, said.

“But awareness-raising actions also need to be embraced by those responsible for these people.”

Illegal platforms a threat to preventing minors betting

While sites authorised by the Secretariat of Prizes and Bets (SPA) are mandated to apply age restrictions, illegal operators don’t adhere to the same requirements.

This is a key concern for the ANJL. “Legalised platforms follow the guidelines imposed by Brazilian legislation,” Lemos Jorge added. “And, therefore, we have been able to implement ways to prevent access by minors.

“In the case of websites that are not authorised to operate in the country, the reality is different. Children are not only able to access without proper registration, but are also encouraged to play.”

Protection of minors in Brazil

The ANJL, which represents established operators such as BetNacional and Big Brazil, has been at the forefront of efforts to protect minors from the harms of betting.

It launched a campaign in October called “Betting is not a child’s thing” aiming to combat the use of betting platforms from those under the age limit by raising awareness of the dangers.

On 6 December with the legal market just weeks away, the SPA published Normative Ordinance No 1,902 to expedite the adoption of a number of measures set out in July, which focused on operators advertising in Brazil.

Normative Ordinance No 1,902 immediately banned advertising that targets minors, as well as marketing through channels where those ages 17 and under form the majority of the audience.

Ads that featured children or elements considered “particularly appealing” to minors were prohibited, while all operator communications were mandated to display either an ‘18+’ symbol or a message with the text “prohibited for people under 18”.
